Scope of Survey

  • The survey is a visual inspection only, carried out using reasonable skill and care, without dismantling the vessel or its systems.

  • Areas that are not accessible or visible at the time of inspection will not be included.

  • The survey reflects the vessel’s condition on the day of inspection only.

  • The Surveyor shall carry out the survey as described in the quotation, in accordance with the International Institute of Marine Surveying (IIMS) Code of Practice and recognized industry   standards.

  • The Surveyor will not provide opinions on areas or components that are not directly accessible or visible at the time of inspection.

  • The Surveyor is not responsible for hidden defects, latent faults, or future failures of materials or systems.

Limitations

  • The survey does not constitute a guarantee, warranty, or insurance of the vessel’s condition.

  • Hidden defects, areas not accessible, or issues that cannot be identified without intrusive testing are outside the scope.

  • Engine, mechanical, electrical, and electronic systems are examined only to the extent visible and operational at the time.

Client Responsibilities

  • The Client is responsible for arranging haul-out, sea trials, and crew availability, if required.

  • The Client shall ensure that the Surveyor has safe and reasonable access to the Vessel at the agreed location and time.

  • The Client (or their representative) is responsible for ensuring the Vessel is securely supported, safe to board, and that electrical power, keys, and documentation are available as required.

Report & Use

  • The survey report is prepared exclusively for the client and should not be relied upon by third parties without written consent.

  • The report is intended to assist the client in making an informed decision; it is not a valuation for legal or insurance purposes unless explicitly requested.

  • The Surveyor retains copyright in all written reports and photographs unless otherwise agreed.

Fees & Payment

  • Survey fees are agreed in advance and payment in full is required prior to release of the written report.

  • Interest at 2% per month may be charged on overdue accounts.

  • The surveyor reserves the right to withhold the report until payment is received.

  • Additional costs such as travel, haul-out, or specialist testing (if requested) are to be covered by the client.

Acceptance

  • By signing this document by hand, electronically, replying in writing to the quotation, or otherwise instructing Yacht Survey Bureau to proceed, the Client acknowledges that they have read, understood, and agreed to these Terms and Conditions.

Cancellation and Postponement

  • Should the Client cancel within 48 hours of the agreed survey date, a cancellation fee of up to 50% of the quoted fee may be charged.

  • If weather, yard access, or other circumstances beyond the Surveyor’s control prevent completion, the Surveyor may reschedule at no penalty to either party.

Liability

  • The Surveyor shall exercise all reasonable skill, care, and diligence in the performance of the survey.

  • The Surveyor’s liability to the Client, whether in contract, tort (including negligence), or otherwise, shall be limited to a maximum of five (5) times the fee paid for the survey or £5,000, whichever is less.

  • The Surveyor shall not be liable for:

    • Indirect or consequential loss, loss of use, or loss of profit.

    • Errors or omissions resulting from inaccurate or incomplete information supplied by the Client or third parties.

    • Changes in condition of the Vessel after the time of inspection.

  • The Surveyor’s opinion represents a condition assessment at the time of survey only; it is not a guarantee of seaworthiness or valuation.

  • Any claim must be made in writing within six (6) months of the report date, after which liability shall cease.

Governing Law and Jurisdiction

  • These Terms shall be governed by and construed in accordance with the laws of England and Wales.

  • Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
